Welcome to LimoncellaBy! The terms "we", "us", and "our" refer to LimoncellaBy. LimoncellaBy operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the "Services"). LimoncellaBy runs on the Shopify platform, which enables us to provide the Services to you.

When you place an order, you are making an offer to purchase. LimoncellaBy reserves the right to accept or decline your order for any reason, at our sole discretion. Your order is not accepted until LimoncellaBy confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as LimoncellaBy may not be able to accommodate cancellation requests after an order has been accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you by contacting the email address, billing address, and/or phone number provided at the time the order was placed.
You may only return or exchange your purchase in accordance with our Return & Refund Policy (/policies/refund-policy).
You represent and warrant that your purchases are for your own personal or household use, and not for commercial resale or export.
SECTION 4 – PRICING AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price of a product or service is the price in effect at the time the order is placed, as indicated in the order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.
Prices listed in our online store may differ from prices offered in a physical store, another online store, or any third-party retail channel. We may, from time to time, offer promotions through the Services that may affect pricing and that are governed by terms separate from these Terms. In the event of a conflict between the terms of a promotion and these Terms, the promotion's terms will govern.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made in our stores. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is truthful, accurate, and complete, (ii) you are duly authorized to use the credit card(s) for your purchases, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay the charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes.
SECTION 5 – SHIPPING
We are not responsible for shipping delays. All delivery times are estimates only and cannot be guaranteed. We are not liable for delays caused by the carrier, customs processing, or events beyond our control. Once products have been handed over to the shipping carrier, ownership and risk of loss transfer to you.

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, along with their design, selection, and arrangement, are the property of LimoncellaBy, its affiliates, or licensors, and are protected by U.S. and international patent, copyright, and other intellectual property laws.

Such trademarks may not be used without the prior written permission of LimoncellaBy. The Shopify name, logo, and product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing in the Services are trademarks of their respective owners.

We may provide you with access to third-party tools as part of the Services, over which we neither monitor nor have any control or input.

SECTION 9 – YOUR RELATIONSHIP WITH SHOPIFY
LimoncellaBy runs on the Shopify platform, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LimoncellaBy. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sale between you and LimoncellaBy, including but not limited to any injuries, damages, or losses arising from products or services purchased. You hereby release Shopify and its affiliates from any and all claims, damages, and liabilities arising from or related to your purchase and transaction with LimoncellaBy.

Any personal information we collect through the Services is governed by our Privacy Policy, available here (/policies/privacy-policy), and certain personal information may also be governed by Shopify's Privacy Policy, available here. By using the Services, you confirm that you have read these privacy policies.
Because Shopify hosts the Services, Shopify collects and processes personal information related to your use of the Services in order to provide and improve the Services for you. Information you submit through the Services is transferred to and shared with Shopify and third parties, who may be located outside your country of residence, in order to provide you with services. You further agree not to: (a) upload or transmit viruses or any other type of malicious code that is used or may be used in any way that will affect the functionality or operation of the Services; (b) copy, reproduce, distribute, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or engage in other misleading or fraudulent practices on the Services; (e) use robots, spiders, scrapers, data collection or extraction tools, automated devices or processes, artificial intelligence tools (including agentic AI), or automated or manual means to access the Services; or (f) interfere with, circumvent, or bypass security or authentication features, robot exclusion headers, or other measures we use to restrict access to the Services. 14.4 Agents must: (i) identify, in all HTTP/HTTPS requests, that the request originates from an Agent, and disclose the Agent's name by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not disguise or obscure that access, use, or interactions originate from an Agent, for example by (a) mimicking human behavior and interaction patterns, or (b) completing or bypassing CAPTCHAs or taking actions intended to distinguish computer use from human use; (iii) respond truthfully to any questions or prompts intended to determine whether an interaction originates from a human or a computer; (iv) not circumvent or otherwise avoid any measures intended to prevent, restrict, alter, or monitor whether and how Agents access Shopify's consumer-facing services or interact with them.

We may terminate this agreement or your access to the Services (or any part thereof) at our sole discretion, at any time, without notice, and you will remain responsible for all amounts due up to and including the date of termination.
The following sections shall survive any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other terms that by their nature should survive termination.

UNLESS LIMONCELLABY EXPRESSLY STATES OTHERWISE, THE SERVICES AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT OR REPRESENT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIMONCELLABY, OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
SECTION 18 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless LimoncellaBy, Shopify, and our and their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers, from any liability, regardless of source, from any loss, damage, liability, or claim, including reasonable attorneys' fees, made by any third party due to or arising from (1) your breach of these Terms of Service or any documents incorporated by reference, (2) your violation of any law or the rights of a third party, or (3) your use of the Services.
We will provide you with notice of any such claims, provided that failure to promptly notify you shall not relieve you of your obligations hereunder, except to the extent you are materially prejudiced. We may control the defense and settlement of any such claim at your expense, including the selection of counsel, but we will not settle any claim that requires a non-monetary obligation on your part without your consent (which shall not be unreasonably withheld). You agree to cooperate in the defense of any such claims, including by providing relevant documentation.

You and LimoncellaBy submit to the personal jurisdiction of said courts.
